  {"id":90,"date":"2019-01-09T16:01:35","date_gmt":"2019-01-09T16:01:35","guid":{"rendered":"http:\/\/www.montclair.edu\/sponsored-programs\/?page_id=90"},"modified":"2021-09-27T09:11:05","modified_gmt":"2021-09-27T13:11:05","slug":"uniform-guidance","status":"publish","type":"page","link":"https:\/\/www.montclair.edu\/sponsored-programs\/compliance\/uniform-guidance\/","title":{"rendered":"Uniform Guidance"},"content":{"rendered":"<h2>What is the Uniform Guidance?<\/h2>\n<p>The \u201c<a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5\" target=\"_blank\">Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards<\/a>, or \u201cUniform Guidance\u201d was adopted to consolidate and streamline the regulatory framework governing the administration of federal grants as well as create efficiencies and increased transparency. \u00a0It replaces and consolidates eight (8) Office of Management and Budget (OMB) circulars, including those circulars that have guided ÌÇÐÄvlog\u2019s receipt and administration of federal grants for the past several decades\u2014specifically, OMB A-21 (Cost Principles), OMB A-110 (Administrative Requirements) and OMB A-133 (Audit Requirements).<\/p>\n<h2>When does the Uniform Guidance take effect?<\/h2>\n<p>The \u201cUniform Guidance\u201d will take effect on December 26, 2014 and will apply to new awards\u00a0<em>and\u00a0<\/em>incremental funding on existing awards (e.g., Year two of a three-year federal grant) received\u00a0<em>after<\/em>\u00a0December 26, 2014.<br \/>\nFederal awards that were fully funded prior to December 26, 2014 will continue to be governed by the terms and conditions that existed at the time of award\u00a0 (i.e., in most cases, previously funded awards will be governed by OMB Circulars A-21, A-110, and A-133).<\/p>\n<h2>How will the Uniform Guidance impact ÌÇÐÄvlog?<\/h2>\n<p>A summary of major applicable changes and their impact is listed in the table below.\u00a0 With regard to the allowability of items of cost on federal grants, little has changed.\u00a0 However, some notable changes include the allowance of administrative costs on federal awards under certain conditions.\u00a0 In addition, the treatment of \u201ccomputing devices\u201d has been modified to include printers, peripherals, storage devices, etc., and are allowable for devices that are essential and allocable to a specific project, but not\u00a0<em>solely<\/em>\u00a0dedicated, to the performance of that project (as was the case under the previous guidelines).<br \/>\nOther changes pertain to university requirements in receiving and administering federal awards.\u00a0 For example, universities are required to broaden their Financial Conflict of Interest Policy to apply\u00a0to all federal grants regardless of the agencies funding them (prior regulations limited the FCOI application solely to PHS and NSF funded projects). \u00a0The Uniform Guidance also imposes additional requirements upon the federal agencies with regard to their interactions with federal awardees\u00a0 (e.g., 60-day advance notice of funding opportunities).<br \/>\nThe Uniform Guidance is organized into six (6) subparts, A-F, and 11 appendices. No funding opportunity may be available for less than 30 days.<\/td>\n<td>Applicants will have additional time to prepare applications for submission.<\/td>\n<\/tr>\n<tr>\n<td>Federal Agency Review of Risk Posed by Applicants<\/td>\n<td><a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#se2.1.200_1205\" target=\"_blank\">C (\u00a7200.204)<\/a><\/td>\n<td>Prior to issuing an award, federal agencies are required to review available information (e.g., financial data) and evaluate risk.<\/td>\n<td>Prior to award, agencies may request additional data from the University concerning its history of performance, financial reporting, and quality of management systems.<\/td>\n<\/tr>\n<tr>\n<td>Subrecipient vs. Contractor Determination<\/td>\n<td><a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#se2.1.200_1330\" target=\"_blank\">C (\u00a7200.330)<\/a><\/td>\n<td>The University must make case-by-case determinations whether each agreement it makes for the disbursement of Federal funds casts the party receiving the funds in the role of a\u00a0subrecipient\u00a0or a\u00a0contractor. The Federal awarding agency may supply and require \u00a0the University to comply with additional guidance to support these determinations<\/td>\n<td>May require the University to provide additional reporting to the federal funding agency concerning the pass-through entity prior to a subaward.\u00a0 However, the federal agency will provide guidance as to the additional information needed in connection with subawards.<\/td>\n<\/tr>\n<tr>\n<td>Cost-Sharing<\/td>\n<td><a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#se2.1.200_1306\" target=\"_blank\">D (\u00a7200.306)<\/a><\/td>\n<td>\n<ul>\n<li>Voluntary committed cost sharing is\u00a0prohibited\u00a0on federal research proposals except where otherwise provided by statute.<\/li>\n<li>Cost-sharing\u00a0will not\u00a0be used as a factor in the review of applications, and is only required if specified in the funding opportunity announcement.<\/li>\n<\/ul>\n<\/td>\n<td>The University\u2019s current policy applicable to NSF grants is now extended to all federal funded grants.\u00a0 Proposals will be judged on review criteria that does not take into consideration a voluntary cost-share commitment.<\/td>\n<\/tr>\n<tr>\n<td>Financial and Program Management<\/td>\n<td><a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#se2.1.200_1301\" target=\"_blank\">D (\u00a7200.301)<\/a><\/td>\n<td>\n<ul>\n<li>Federal agencies must collect standardized \u201cperformance data\u201d elements.<\/li>\n<li>Performance is measured to improve performance outcomes.<\/li>\n<li>The University will be required to demonstrate responsible procurement and costing practices.<\/li>\n<\/ul>\n<\/td>\n<td>Reporting to the federal funded agency on performance ensures increased accountability to the federal government.<\/td>\n<\/tr>\n<tr>\n<td>Fixed Amount Subawards<\/td>\n<td><a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#se2.1.200_1332\" target=\"_blank\">D (\u00a7200.332)<\/a><\/td>\n<td>With prior written approval from the federal awarding agency, a pass-through entity may provide subawards based on fixed amounts up to the Simplified Acquisition Threshold ($150,000), provided that the subawards meet the requirements for fixed amount awards set forth in 2 C.F.R. \u00a7200.201 (Use of grant agreements (including fixed amount awards), cooperative agreements, and contracts).<\/td>\n<td>Provides flexibility to the University in the issuance of fixed-price contracts to subrecipients.\u00a0 For example, where familiarity might not exist, payment might be based on performance or deliverables.<\/td>\n<\/tr>\n<tr>\n<td>Subrecipient Monitoring and Management<\/td>\n<td>\u00a0<a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#sg2.1.200_1329.sg5\" target=\"_blank\">D (\u00a7200.301)<\/a><\/td>\n<td>\n<ul>\n<li>Institutions must evaluate each subrecipient\u2019s risk of noncompliance with Federal statutes, regulations, and the terms and conditions of the subaward.<\/li>\n<li>The University must include additional data elements in subaward agreements at time of award.<\/li>\n<li>The University must monitor the activities of the subrecipient as necessary to ensure fiscal and programmatic compliance.<\/li>\n<li>The University must be given access to subrecipient\u2019s financial and programmatic records to meet the federal agency\u2019s audit requirements.<\/li>\n<li>The University must include a management decision for audit findings on weaknesses of a subrecipient on federal awards and follow up to ensure corrective action.<\/li>\n<\/ul>\n<\/td>\n<td>The University must meet specific pre-award and post-award assessment and monitoring requirements when entering into federally funded subaward contracts.<\/td>\n<\/tr>\n<tr>\n<td>Procurement Standards<\/td>\n<td><a rel=\"noopener noreferrer\" href=\"http:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=ee873e1aa906cf3b0d7474d25be3b5a9&amp;node=2:1.1.2.2.1&amp;rgn=div5#sg2.1.200_1316.sg3\" target=\"_blank\">D (\u00a7200.317-326)<\/a><\/td>\n<td>Detailed procurement methods that must be followed to purchase goods and services valued at $3,000 or more with the use of federal funds.<\/td>\n<td>Note: OMB is providing a one-year grace period to December 26, 2015 for universities to comply with these standards.
